These Terms of Service (āTermsā) govern your access to and use of the Brizzy web application, website, and related services (collectively, the āServiceā), provided by Vanclaro OĆ (āBrizzyā, āVanclaroā, āweā, āusā, or āourā).
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. If the laws of your country require a higher minimum age for consent to data processing or use of digital services, that higher age applies.
By using the Service, you represent that you are legally able to enter into these Terms and are not prohibited from using the Service under applicable law.
2. Your Account
You may need to create an account to access some features of the Service. You agree to provide accurate, complete, and up-to-date information and to keep your login credentials or sign-in methods secure.
You are responsible for all activity under your account. If you believe your account has been compromised or used without authorization, contact us promptly at support@vanclaro.com.
We may send you transactional communications related to your account or the Service, including login links, billing notices, security alerts, and service-related updates.
3. Acceptable Use
You agree not to use the Service to:
- break the law or violate the rights of others;
- harass, abuse, harm, threaten, mislead, or impersonate another person;
- upload, submit, or share content you do not have the right to use;
- access, collect, scrape, extract, or use data you are not authorized to access;
- interfere with, disrupt, probe, overload, or degrade the Service or the systems of our providers;
- use bots, scripts, or automated methods to access the Service at abusive rates;
- reverse-engineer, decompile, or attempt to discover source code or underlying models, except where such restriction is prohibited by law;
- use the Service or its outputs to build, train, benchmark, or improve a competing product, model, or service, unless we expressly allow it in writing;
- attempt to bypass security, rate limits, access restrictions, or protective technical measures.
We may suspend or restrict access if we reasonably believe you have violated these Terms or created risk for the Service, other users, or us.
4. Health and Well-Being Disclaimer
Brizzy is a wellness and guided breathing service for general informational and well-being purposes only. Brizzy is not a medical device and does not provide medical advice, diagnosis, treatment, therapy, or emergency services.
The Service is not a substitute for professional medical, psychological, or psychiatric care. Always consult a qualified healthcare professional before starting breathing exercises, breath-hold practices, or other wellness activities, especially if you have any medical condition, cardiovascular or respiratory issues, anxiety or panic symptoms, are pregnant, or have any other health concerns.
If you feel pain, dizziness, faintness, distress, or discomfort while using the Service, stop immediately and seek appropriate professional advice. If you believe you are experiencing a medical or mental health emergency, contact your local emergency services immediately.
Your use of the Service is voluntary and at your own risk.
5. AI and Generated Content
Some parts of the Service may include AI-generated or automated guidance, suggestions, summaries, or other outputs.
You understand and agree that:
- AI-generated content may be inaccurate, incomplete, outdated, generic, or unsuitable for your situation;
- such content is provided for general informational and wellness purposes only;
- AI-generated content does not constitute medical, therapeutic, legal, financial, or other professional advice;
- you are responsible for evaluating any output before relying on it.
You should not rely on the Service or its outputs in place of qualified professional judgment or in any emergency situation.
6. User Content
You may be able to submit, upload, store, or share content through the Service, including text, notes, prompts, preferences, or other materials (āUser Contentā).
You retain any rights you have in your User Content. However, by providing User Content through the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, adapt, display, and transmit that content solely as necessary to operate, maintain, improve, secure, and provide the Service to you.
You represent and warrant that:
- you have the rights necessary to provide the User Content;
- your User Content does not violate any law or the rights of any third party;
- your User Content does not contain unlawful, abusive, fraudulent, or harmful material.
We may remove or restrict User Content that we reasonably believe violates these Terms or applicable law.
7. Feedback
If you send us suggestions, ideas, comments, or feedback about the Service, you agree that we may use that feedback without restriction or compensation to you, for any lawful purpose, including improving the Service and developing new features.
8. Ownership and License
The Service, including its software, design, branding, content, text, graphics, interfaces, and other materials, is owned by or licensed to Vanclaro OĆ and is protected by intellectual property and other applicable laws.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, internal, and lawful use.
Except as expressly permitted in these Terms or by law, you may not copy, distribute, modify, create derivative works from, sell, lease, sublicense, or otherwise exploit the Service or any part of it.
9. Third-Party Services
The Service may rely on or integrate with third-party providers, including, for example:
- Supabase (authentication and database infrastructure)
- Vercel (hosting and deployment)
- Simple Analytics (privacy-focused analytics)
- Stripe (payments)
- Google OAuth or other third-party sign-in providers, if you choose to use them
Your use of third-party services may also be subject to those third partiesā own terms, privacy policies, and rules. We are not responsible for third-party services or their acts or omissions.
10. Privacy
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect personal data.
By using the Service, you acknowledge that your personal data may be processed in accordance with our Privacy Policy.
11. Subscriptions, Billing, and Refunds
Some features of the Service may require payment. If you purchase a subscription:
- fees are billed in advance on a recurring basis, as shown at checkout;
- your subscription renews automatically unless you cancel before the next renewal date;
- you can cancel at any time through your account settings or by contacting us, and your access will continue until the end of the current paid billing period;
- unless otherwise stated, prices may be updated from time to time, and we will provide notice before material pricing changes take effect for your next billing cycle.
You are responsible for any applicable taxes, duties, or similar charges unless the law requires us to collect and remit them differently.
Refunds
You may request a full refund within 7 days of your initial subscription purchase by contacting support@vanclaro.com.
After that 7-day period, refunds are provided only where required by applicable law or at our discretion.
Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.
12. Changes to the Service and Availability
We may modify, update, suspend, or discontinue all or part of the Service at any time, including features, functionality, or availability.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. Temporary interruptions may occur due to maintenance, updates, outages, or factors beyond our control.
13. Changes to These Terms
We may update these Terms from time to time.
If we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms on the Service or by other appropriate means. Unless otherwise stated, updated Terms become effective when posted.
By continuing to use the Service after the updated Terms take effect, you agree to the revised Terms. If you do not agree, you must stop using the Service.

To the fullest extent permitted by law, the Service is provided on an āas isā and āas availableā basis.
We make no warranties or representations, express or implied, about the Service, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or security.
We do not guarantee that the Service will meet your requirements, that any content or output will be accurate or suitable, or that defects will be corrected.
15. Limitation of Liability
To the fullest extent permitted by law, Vanclaro OĆ, Brizzy, and our affiliates, directors, officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business opportunities, goodwill, data, or expected savings, arising out of or related to your use of, or inability to use, the Service.
To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of:
- EUR 50; or
- the amounts you paid to us for the Service during the 3 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protections.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Vanclaro OĆ and its affiliates, officers, directors, employees, and contractors from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your misuse of the Service;
- your violation of these Terms;
- your violation of any law or third-party rights;
- your User Content.
17. Termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate your access to the Service, with or without notice, if we reasonably believe that:
- you violated these Terms;
- you created legal, operational, or security risk;
- we are required to do so by law;
- continued provision of the Service is no longer commercially or technically feasible.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including sections relating to ownership, disclaimers, limitations of liability, indemnity, governing law, and dispute-related matters.
18. Governing Law
We aim to comply with applicable European Union laws and requirements, including the GDPR where applicable.
Mandatory consumer protection laws of your country of residence will continue to apply where required by law. Subject to those mandatory protections, these Terms are governed by the laws of Estonia, without regard to conflict-of-laws principles.
19. General
These Terms, together with our Privacy Policy and any additional terms expressly incorporated by reference, form the entire agreement between you and us regarding the Service.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms is not a waiver of that provision.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets, or by operation of law.
